  1. IMPORTANT - READ THIS BEFORE INSTALLING: By installing, using, or
  2. reproducing the enclosed materials, you are agreeing to be bound by the terms
  3. of this agreement.  If you do not agree to them, do not install or use this
  4. software.

  6. Intel Indeo« video Software License Agreement
  7.  
  8. LICENSE: Subject to the Restrictions below, Intel Corporation ("Intel") grants
  9. to you the following non-exclusive, non-assignable, royalty-free copyright
  10. licenses in the "Materials" below, which are identified specifically in the
  11. enclosed documentation.
  12. End-User Documentation includes textual materials intended for end users.
  13. You may copy, modify and distribute them.
  14. Licensed Binaries are redistributable code provided in binary form.  You may
  15. copy and distribute Licensed Binaries with your product.
  16.  
  17. RESTRICTIONS: You will make reasonable efforts to discontinue distribution of
  18. the enclosed Materials upon Intel's release of an update, upgrade or new
  19. version of the Materials and to make reasonable efforts to distribute such
  20. updates, upgrades or new versions to your customers who have received the
  21. Materials herein.

  23. You may not reverse-assemble, reverse-compile, or otherwise reverse-engineer
  24. any software provided solely in binary form.
  25.  
  26. Distribution of the Materials is also subject to the following limitations you
  27. (i) shall be solely responsible to your customers for any update or support
  28. obligation or other liability which may arise from the distribution, (ii) do
  29. not make any statement that your product is "certified," or that its
  30. performance is guaranteed, by Intel, (iii) do not use Intel's name or
  31. trademarks to market your product without written permission, (iv) shall
  32. prohibit disassembly and reverse engineering, and (v) shall indemnify, hold
  33. harmless, and defend Intel and its suppliers from and against any claims or
  34. lawsuits, including attorney's fees, that arise or result from your
  35. distribution of any product.

  37. COPYRIGHT: Title to the Materials and all copies thereof remain with Intel or
  38. its suppliers.  The Materials are copyrighted and are protected by United
  39. States copyright laws and international treaty provisions.  You will not remove
  40. any copyright notice from the Materials.  You agree to prevent any unauthorized
  41. copying of the Materials.  Except as expressly provided herein, Intel does not
  42. grant any express or implied right to you under Intel patents, copyrights,
  43. trademarks, or trade secret information.

  45. REPLACEMENTS: The Materials are provided "AS IS" without warranty of any
  46. kind.  If the media on which the Materials are furnished are found to be
  47. defective in material or workmanship under normal use for a period of ninety
  48. (90) days from the date of receipt, Intel's entire liability and your
  49. exclusive remedy shall be the replacement of the media.  This offer is void
  50. if the media defect results from accident, abuse, or misapplication.

  52. LIMITATION OF LIABILITY: THE ABOVE REPLACEMENT PROVISION IS
  53. THE ONLY WARRANTY OF ANY KIND.  INTEL OFFERS NO OTHER
  54. WARRANTY EITHER EXPRESS OR IMPLIED INCLUDING THOSE OF
  55. MERCHANTABILITY, NONINFRINGEMENT OF THIRD-PARTY INTELLECTUAL
  56. PROPERTY OR FITNESS FOR A PARTICULAR PURPOSE.  NEITHER INTEL
  57. NOR ITS SUPPLIERS SHALL BE LIABLE FOR ANY DAMAGES WHATSOEVER
  58. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
  59. PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION,
  60. OR OTHER LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE
  61. THE SOFTWARE, EVEN IF INTEL HAS BEEN ADVISED OF THE
  62. POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME JURISDICTIONS
  63. PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR
  64. CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY
  65. NOT APPLY TO YOU.

  67. TERMINATION OF THIS LICENSE: Intel may terminate this license at any time
  68. if you are in breach of any of its terms and conditions.  Upon termination,
  69. you will immediately destroy the Materials or return all copies of the
  70. Materials to Intel along with any copies you have made.

  72. U.S. GOVERNMENT RESTRICTED RIGHTS: The Materials are provided with
  73. "RESTRICTED RIGHTS." Use, duplication or disclosure by the Government is
  74. subject to restrictions set forth in FAR52.227-14 and DFAR252.227-7013 et
  75. seq. or its successor.  Use of the Materials by the Government constitutes
  76. acknowledgment of Intel's rights in them.

  78. APPLICABLE LAWS: Any claim arising under or relating to this Agreement shall
  79. be governed by the internal substantive laws of the State of Delaware or
  80. federal courts located in Delaware, without regard to principles of conflict
  81. of laws.  You may not export the Materials in violation of applicable export
  82. laws.
